Terms of Service

The rules of using the app, in plain sentences.

Saša Marić · Wagna, Austria

Effective date: 6 June 2026 Last updated: 7 October 2026

These Terms of Service ("Terms") govern your use of the Overthink This mobile application (the "App"), operated by Saša Marić, Fux-Weg 26, 8435 Wagna, Austria ("we", "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be:

If you are using the App on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms.

2. What the App is — and what it is NOT

Overthink This is an entertainment and self-reflection tool. It helps you map a worry, generate hypothetical outcomes, and journal resolutions. The App, including its "verdicts", "outcomes", "action steps", "Oracle Mode", and "Bible mode" outputs, is produced by artificial intelligence and is fictional, advisory, and for entertainment purposes only.

The App is not:

You agree not to rely on the App as the sole basis for any decision involving your health, safety, finances, or legal status.

3. Your account

You are responsible for:

We may suspend or close accounts that we reasonably believe are shared, automated, or otherwise abuse the App.

4. Your content

You retain ownership of the text you submit ("Your Content"). By using the App you grant us a limited, worldwide, royalty-free, non-exclusive licence to host, store, process, transmit, and display Your Content strictly for the purpose of operating the App (including running the safety classifier, generating AI responses, and rendering your archive). This licence ends when you delete the content or your account, except for backups retained for the durations described in our Privacy Policy.

If you choose to publish Your Content to the in-app social feed (Section 4A), you additionally grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, distribute, and otherwise make that published content available within the App to other users for as long as the post remains live. You can revoke this licence at any time by deleting the post from the App. This wider licence is limited to feed-related display — we will not republish posts outside the App, sell them, or licence them to third parties.

You promise that Your Content does not:

We do not pre-screen content, but we may review, block, or remove content that we reasonably believe violates these Terms.

4A. The public feed, friend system, and notifications

4A.1 Posting is opt-in

By default everything you write stays private to your account. Only items you explicitly share through the "Share" sheet appear on the social feed. You must be signed in with Google to post — guest accounts cannot publish to the feed. We require a signed-in account so we have a stable identity to enforce moderation against.

4A.2 What appears on a post

A post snapshots the spiral / text-check / compatibility verdict at the moment you shared it, together with your display name, avatar, level, title, and any active cosmetic. Other users may like or comment on your post. Comments are governed by these Terms and the Community Guidelines.

4A.3 Deletion and moderation

You can delete any post or any of your own comments at any time. We may remove posts or comments that we reasonably believe violate these Terms, and we may apply the strike system described in Section 7 to the author.

4A.4 Friends, blocks, and discovery

You can search for other users by display name, send friend requests, accept or reject incoming requests, remove friendships, and block any user. Blocking is one-directional, hides the blocked user from your feed, and prevents them from sending you new requests or messaging you within the App. Banned accounts are automatically hidden from every social surface; if a user is later unbanned, they reappear.

4A.5 Notifications

If you grant the OS push permission, we may send notifications when someone likes or comments on your posts. You can turn each category off at any time in Profile → Notifications, or revoke the system permission entirely. We do not send marketing pushes.

4A.6 No expectation of privacy on the feed

Anything you publish on the feed is visible to every other signed-in user. Do not post information you would not want a stranger to see. We are not responsible for how other users redistribute content they encountered through the feed.

4A.7 Rate limits and abuse prevention

We apply automatic rate limits on sign-in attempts, AI generation, posting, liking, commenting, friend requests, and search. Exceeding the limits results in a temporary 429 response with a "retry after" hint. Repeated attempts to circumvent the rate limits or the safety system are themselves a violation of these Terms.

5. AI output

The App generates AI output ("Output") via third-party services. Output is:

You may use Output for personal purposes. You may not:

Bible Mode references real scripture. We do not endorse any particular interpretation; verse selection is automated.

Oracle Mode renders your spiral in the voice of a fictional archetype card (for example "The Hermit" or "The Fool"). The cards are invented characters, not real people; the Output is clearly fictional commentary on your spiral and is not a prediction, a divination, or advice.

6. Acceptable use — Community Guidelines

You agree not to submit text that:

  1. Describes you doing, planning, threatening, or fantasising in detail about a serious harm against another identifiable person, child, or animal (violence, sexual assault, stalking, kidnapping, terrorism, animal cruelty, hate-motivated harm).
  2. Constitutes incitement, harassment, or hate speech directed at a protected class.
  3. Contains child sexual content of any kind.
  4. Contains real-world personal information about other people (addresses, phone numbers, government IDs, etc.) without their consent.
  5. Is intended to defeat or game the safety classifier (e.g., role-play prompts).
  6. Violates intellectual-property law (e.g., pasting copyrighted works in bulk).
  7. Promotes illegal goods or services.

Submitting prohibited content does not generate a spiral. The App's safety classifier will refuse, record a strike, and at the third strike will ban the account. Bans are appealable (see Privacy Policy §10).

If your text indicates that you yourself are in crisis (suicidal ideation, ongoing domestic abuse, severe self-harm, etc.), the App will hold the spiral and surface professional crisis resources. You can still choose to proceed; this is not moderation, it is a check-in.

The App's full Community Guidelines are reproduced separately at https://overthinkthis-legal.netlify.app/community-guidelines and form part of these Terms.

7. Strikes, cooldowns, and bans

We operate a three-strike moderation system:

StrikesConsequence
1Warning shown; the offending spiral is not generated.
2Same as above.
3Account is banned. You lose access to the App.

In addition, we may place an account on a temporary cooldown instead of a ban (e.g., 7 / 14 / 30 days) at our discretion when the violation is severe but not at three strikes.

You may appeal any moderation decision within 30 days by emailing fizzythemusician@gmail.com. We review appeals within 14 days. If your appeal succeeds, we restore your access and the strike is removed.

Banned users may not create a new account to evade the ban; doing so is a separate violation.

8. Subscriptions and in-app purchases

8.1 Plans

Overthink This Pro is offered as:

Prices are shown in-app, are inclusive of applicable VAT, and may vary by country.

8.2 Billing

Purchases are processed by Google Play Billing under Google's own terms. We do not see or store payment-card data. The charge appears on your statement as "Overthink This".

Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before renewal. To cancel:

Cancellation takes effect at the end of the current billing period. You keep Pro access until that date.

8.3 Refunds

Purchases through Google Play are subject to Google's refund policy. We do not directly process refunds; please request them through Google Play.

In the EU you have a 14-day right of withdrawal for digital content unless you have started consuming the service. By starting your first AI generation you waive this right (Article 16(m) of Directive 2011/83/EU). This does not affect any other statutory right.

8.4 Free trial / 2-day Pro drops

The App may grant free Pro access at certain Thinkpass+ tiers (e.g., 2 days at level 10). These trials do not auto-convert to a paid subscription and do not require payment information. When the trial ends, the account returns to the Free tier.

9. Modifications to the App

We may add, change, or remove features at any time, including the AI providers we use, the cosmetic catalogue, the XP curve, the task list, and the moderation rules. Material changes are announced in-app or via these Terms.

10. Disclaimer of warranties

THE APP AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI OUTPUT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE FROM ATTACK, FREE OF VIRUSES, OR THAT AI OUTPUT WILL BE FACTUAL, USEFUL, RELIGIOUSLY ACCURATE, OR PREDICTIVE OF ANY FUTURE EVENT.

Nothing in these Terms excludes or limits our liability for: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by our negligence; (c) any liability that cannot be excluded under applicable law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE APP — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE — IS LIMITED TO THE GREATER OF:

(a) the total amount you have paid us through the App in the 12 months immediately preceding the event giving rise to the claim, OR

(b) €50.

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS; LOSS OF DATA; LOSS OF GOODWILL; OR LOSS OF BUSINESS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The above limitations apply to the maximum extent permitted by applicable law. They do not affect any statutory rights of consumers that cannot be waived.

12. Indemnity

You agree to defend, indemnify, and hold us harmless against any third-party claim, liability, loss, or expense (including reasonable legal fees) arising from:

13. Termination

You can stop using the App and delete your account at any time via Profile → Delete account.

We may suspend or terminate your access immediately and without notice if you:

On termination: clauses 4 (Content licence — to the extent of pre-existing licences), 5 (AI Output disclaimers), 10–12 (warranties, liability, indemnity), 14 (governing law), and 15 (general) survive.

14. Governing law and venue

These Terms are governed by the laws of the Republic of Austria, excluding its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Disputes are subject to the exclusive jurisdiction of the competent court at the seat of the operator (Bezirksgericht Leibnitz / Landesgericht für Zivilrechtssachen Graz, Austria).

If you are a consumer within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG) or the consumer-law of another EU/EEA Member State, this clause does not deprive you of the protection of mandatory consumer-law provisions of your country of residence, and you may also bring claims before the courts of your country of residence (cf. Art. 18 Brussels I-bis Regulation). The EU Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in alternative dispute resolution proceedings before a consumer arbitration body within the meaning of the Austrian Alternative-Streitbeilegung-Gesetz (AStG).

15. General

16. Apple / Google additional terms (when applicable)

If you obtained the App from the Google Play Store, Google is not a party to these Terms but is a third-party beneficiary entitled to enforce them. The Google Play Terms of Service also apply to your download and use of the App.

If you obtained the App from the Apple App Store (when available), Apple is similarly a third-party beneficiary, and Apple's standard EULA terms (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) apply in addition to ours; where they conflict, Apple's terms govern your relationship with Apple, but our Terms govern your relationship with us.
